Yesterday, our Wills & Estates Associate, Rosy Roberts attended the Aged Care and Elder Law Conference held by the Leo Cussen Institute and presented a paper on CCTV and Aged Care – Recording & Privacy Issues.
Please find attached copy of our CCTV and Aged Care Recording and Privacy Issues paper.
In recent years, we are seeing more and more examples of elder abuse and mistreatment of aged care residents due to hidden camera footage being made public by family members.
This paper focuses on CCTV and elder abuse, the consent and capacity of the resident to be filmed, privacy rights and the surveillance legislation in Victoria.
This area will continue to develop over time following the findings of the Royal Commission into Aged Care Quality and Safety and the CCTV trial being undertaken in South Australian aged care facilities.
